1. Agreement to Terms
By accessing or using the Yrkus website and its URL shortening services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, then you may not access the Service. This agreement constitutes a legally binding contract between you and Yrkus.
2. Description of Service
Yrkus provides a service that allows users to shorten uniform resource locators (URLs), create optional custom slugs, set optional expiration dates for the shortened URLs, and view public, non-personally identifiable analytics for each link. The Service also includes the generation of QR codes for shortened URLs.
3. Acceptable Use Policy
You are solely responsible for the URLs you shorten and the content they link to. By using the Service, you agree not to create short links that point to, promote, or are in any way associated with the following:
- Any content that is illegal, fraudulent, or malicious under applicable law.
- Spam, phishing schemes, or any form of unsolicited advertising.
- Malware, viruses, spyware, or any other malicious code.
- Content that is hateful, defamatory, discriminatory, threatening, or incites violence.
- Pornographic, obscene, or sexually explicit material.
- Content that infringes on the intellectual property rights of others, including copyright, trademark, or patent rights.
- Any content or activity that attempts to harm, disrupt, or compromise the integrity of our Service or its users.
Violation of this Acceptable Use Policy may result in the immediate and permanent deletion of your links and a ban on your IP address from using the Service, without notice.
4. Our Rights
Yrkus reserves the following rights:
- To Monitor and Remove Content: We have the right, but not the obligation, to review any URL shortened through our Service. We reserve the right to remove, disable, or delete any short link at our sole discretion, without prior notice, if we believe it violates these Terms.
- To Prevent Abuse: We actively monitor the use of our Service to prevent abuse. We may implement rate limiting, require CAPTCHA verification, or block IP addresses that demonstrate abusive behavior.
- To Modify the Service: We reserve the right to modify, suspend, or discontinue the Service (or any part or content thereof) at any time with or without notice to you. We will not be liable to you or to any third party for any modification, suspension, or discontinuance of the Service.
5. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of Yrkus and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks may not be used in connection with any product or service without our prior written consent. You retain ownership of the content you link to, but by using our Service, you grant us a license to redirect users to that content.
6. Disclaimers and Limitation of Liability
6.1. "AS IS" Basis
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. YRKUS EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
6.2. No Guarantee of Service
We make no warranty that the Service will meet your requirements, be uninterrupted, timely, secure, or error-free. We are not responsible for the content of any destination URL or for any damages that may result from clicking a short link. You use the Service at your own risk.
6.3. Limitation of Liability
IN NO EVENT SHALL YRKUS, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, OR AGENTS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (i) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (ii) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (iii) ANY CONTENT OBTAINED FROM THE SERVICE; AND (iv) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.
7. Indemnification
You agree to defend, indemnify, and hold harmless Yrkus and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of your use and access of the Service, or from your violation of these Terms.
8. Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
9. Changes to These Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
